 1. General Terms & Conditions

1.1 In General

These General Business Terms shall apply to all business relationships between the Customer and Chic Tiles in their version which is valid at the time of the order for deliveries of all kinds, which Chic Tiles provides towards its Customer insofar as no contradictory written agreements are reached in a purchase or other contract concluded between Chic Tiles and the Customer. Legally relevant declarations and notifications of the Customer after conclusion of the contract (e.g. setting of deadlines, reports of defects, declaration of cancellation or reduction), require a written form in order to be valid.

 2. Conclusion of the contract

All offers of Chic Tiles are without obligation.

For purchase contracts via the Online-Shop www.chictiles.ie or by e-mail.

After receipt of this offer the Customer shall receive an electronic confirmation from Chic Tiles about the receipt of the order, in which the data and the articles ordered by the Customer are listed once in which the data and the articles ordered by the Customer are listed.

3. Delivery date, terms of delivery and shipping cost

3.1 Delivery date:

Between 7 to 15 working days. Our warehouse is in Spain and we depend on the carrier.The delivery times for all products depend on the product and are stated on our website for each product.

If shipping is delayed, so it does not depend on us, the delivery date may change.

3.2 Delivery and Unloading:

 We ship tiles:

  • to any destination within the European Union;

  • to the countries of the European Free Trade Association (EFTA) (Norway, Switzerland, Iceland and Liechtenstein), as well as to the special EU member state territories (e. g. Canary Islands, Ceuta, Melilla, Republic of Cyprus, Gibraltar). Please note all local import taxes and fees are paid by the customer;

The tiles are delivered by trucks equipped with a lifting device and are unloaded from the truck on the road at the customer’s delivery address, except as otherwise provided by the dedicated Customer Support specialist while confirming your order. Therefore, the customer shall ensure that the delivery place is fully accessible for the said vehicles and there is enough space for the goods’ to be unloaded. The delivery to historic city centers and other areas with limited truck traffic and no possibility to unload the goods, may involve extra shipping expenses.

Important! Once you are not sure that the truck will have full access to the delivery address and there will be enough space for the goods to be unloaded, please contact your dedicated Customer Support specialist, so that we could suggest alternative goods delivery routes prior to order confirmation.

In the event you would like to arrange goods unloading from the truck yourself, please contact your dedicated Customer Support specialist, so that we could recalculate the shipping expenses and let you know, if there is any difference.

3.3 Pickup from Storage:

You may arrange order collection from our warehouses in  Spain. 

In this event, apart from the cost of the goods, the total amount payable will include the expenses related to goods packaging and preparation for shipment.
In order to have the total order value calculated, please contact your dedicated Customer Support specialist. Once your order is ready for shipment, you will receive notification by Email with accurate data necessary to arrange order pickup, namely: goods weight, number of cargo units, warehouse address, contact details and shipment reference number.

Once the goods leave the warehouse, all liability for their safety is transferred to the customer.

3.4 Delivery of Goods:

Once the goods are delivered, the customer checks them visually. In the event that any damage to the packaging is revealed, the customer shall describe this in the delivery note. Where required, the carrier representative waits, until the goods are unpacked in order to check their integrity.

The customer or whomever have instructions to receive the delivery must open and check the order for damages prior to signing any paperwork from the courier – in the unlikely event that an item(s) has been damaged note this on the courier’s POD (Proof of Delivery) – ‘DAMAGED’ along with product description.

Should any defective tiles be revealed, the customer, within 24 hours, informs the dedicated Customer Support specialist thereof providing a copy of the shipping document, the photos of the Goods as they were delivered, as well as the photos of all defective tiles. There is no need to give the defective tiles back to the carrier.

In the unlikely event that an item has been damaged in transit please contact ChicTiles by E-Mail: support@chictiles.ie within 24 Hours of receiving your delivery to ensure that you are provided with the replacement as soon as possible.

3.5 Shipping costs:

The shipping is displayed separately when purchasing for each product .

4.1 Cancellation and Return of Goods:

Within 24 hour the customer may cancel the order once placed. After 24 hours the order cannot be canceled if it has already been shipped.

Taking into account that the tiles are delivered with specific transportation, according to the law, in case of order cancelation once the goods has been shipped, only the goods cost will be refunded. The shipping expenses are not refundable. The customer shall arrange and pay for goods transportation to our warehouse.

Once any damaged and/or defective goods are revealed, please inform us within 24 hours upon goods delivery. We will either refund the costs of such goods, or replace them within the shortest time possible.

 4.2 Return of Faulty Goods Received:

We ask that customers fully inspect all products received on the day of the delivery. To ensure a speedy resolution, we must be notified of any items that arrive faulty or damaged within 24hrs of receipt. We will then advise the next course of action, we will contact you and either arrange collection, ask for goods to be returned back to us or disposal of goods, never dispose of goods without our notification.

Please note: All goods reported as faulty will be tested by manufacturers, if it is determined the goods are not faulty or if the faults are deemed to be caused by damage or abuse this will void any warranty, goods will be returned to you and no refund or replacement issued.

 5. Prices

The prices indicated on our website are:

  • VAT inclusive for the EU members;

In the event that a corporate customer is registered in the EU has an international VAT identification number, the respective order invoice is issued net of VAT, and the VAT identification number of the suppling company is specified.

 6. Payment

Chic Tiles offers the payment by credit card, debit card or bank transfer.

 7. Warranty

All products from Chic Tiles come complete with a minimum of 12 months Manufacturers Guarantee, many products are listed with periods longer than 12 months, in these cases the period listed is still a Manufacturers Guarantee.  Different manufacturer’s have different procedures for dealing with faults, on some occasions we will deal with the replacement of goods on their behalf, some companies will only deal with customers direct so we will provide you with all the relevant contacts and information, they will then arrange repair, replacement or advise alternative procedures.

Please note: All goods reported as faulty will be tested by manufacturers, if it is determined the goods are not faulty or if the faults are deemed to be caused by damage or abuse this will void any warranty, goods will be returned to you and no refund or replacement issued.

 8. Product presentations and guarantees

The product presentations on the website can deviate in colour and impression from the actual articles. References to the products do not represent any guarantee. An additional guarantee only exists with the goods delivered by Chic Tiles if this was explicitly stated on the website for the respective article. If applicable, special guarantee terms from the manufacturer of the article will also be shown on the website.

 9. Liability

The liability of Chic Tiles is oriented to the following provisions:

9.1 Chic Tiles shall be liable for damages, which are caused by it or its legal representatives or vicarious agents by wilful intent or gross negligence, unlimited with respect to the amount.

9.2 For damages from the injury to life, body or health Chic Tiles shall also be liable with own, slightly negligent breach of duty or that of its legal representatives or vicarious agents unlimited with respect to the amount.

9.3 In case of negligent breaches of duty Chic Tiles shall be liable for damages from the breach of essential contractual duties, without which it is not possible to achieve the object of the contract and the compliance with which the Customer can as a rule rely upon, limited with respect to the amount to the typically foreseeable damages for the contract. This shall apply accordingly to the negligent breach of essential contractual duties of the legal representatives, executive bodies or vicarious agents of Chic Tiles.

 10. Data protection

10.1The data collected from the Customer within the framework of his order shall be processed and used by Chic Tiles for establishing, executing and terminating the contractual relationship with the Customer, in particular also for processing warranty claims. Personal data of the Customer will only be forwarded to third parties if and insofar as this is necessary for executing the contract, in particular for carrying out the delivery.

10.2 The use of the e-mail address for advertising purposes is only carried out if the Customer has granted his consent in this respect. The same shall apply accordingly to the use of such data for market or opinion research.

 11. Law and jurisdiction

These terms and conditions will be governed by and construed in accordance with Irish law, and any disputes relating to these terms and conditions will be subject to the non-exclusive jurisdiction of the courts of the Republic of Ireland.
